Your privacy matters. This policy explains what data Scalvigo collects, how we use it to run our AI website builder, how AI features handle your inputs, and the rights you have over your information.
1. Overview
This Privacy Policy explains how Scalvigo, Inc. (“Scalvigo”, “we”, “us”) collects, uses, discloses and safeguards personal data when you use the Scalvigo website builder, our websites, AI features and add-ons (the “Service”). It also describes your rights and how to exercise them.
Scalvigo is the data controller for personal data processed about account holders and website visitors of our own site. Where you use Scalvigo to build and operate your own website, you are the controller of the personal data you collect from your visitors, and Scalvigo acts as your processor for that data.
2. Information We Collect
- Account data: name, email address, password (hashed), organization name, and preferences you provide when you register.
- Billing data: billing name, address, and the last digits and type of your payment method. Full card numbers are processed by our PCI-compliant payment processor and are not stored by Scalvigo.
- User Content: the sites, pages, text, images, product photos, and files you create or upload, and inputs you provide to AI features (such as prompts and images).
- Usage and device data: log data, IP address, browser and device type, pages viewed, features used, AI actions performed, and approximate location derived from IP.
- Cookies and similar technologies: identifiers used to keep you signed in, remember preferences, and measure and improve the Service (see Section 5).
- Communications: messages you send to support, sales, or via forms.
3. How We Use Your Information
- To provide, operate, secure and maintain the Service, including hosting and delivering your Published Sites;
- To process AI actions you request, enforce usage limits, and provide AI add-ons;
- To process payments, manage subscriptions and add-ons, and prevent fraud;
- To provide customer support and respond to your requests;
- To send service, security and transactional messages, and — with your consent where required — marketing communications you can opt out of at any time;
- To analyze and improve the Service, develop new features, and ensure reliability and security;
- To comply with legal obligations and enforce our Terms.
4. AI Features and Your Data
When you use AI features, your inputs (such as prompts, text, and images) and the resulting outputs are processed to deliver the requested result. Depending on the feature, processing may be performed by Scalvigo and/or by trusted third-party AI providers acting on our behalf under contractual data-protection commitments.
We do not use your private User Content or AI inputs to train foundation models for advertising or to build user profiles. We may use aggregated, de-identified data to monitor performance, prevent abuse, and improve quality. Do not enter sensitive personal data into AI features unless necessary.
5. Cookies and Tracking Technologies
We use strictly necessary cookies to run the Service (for example, authentication and security), and, with your consent where required, functional and analytics cookies to remember your preferences and understand how the Service is used. You can control cookies through your browser settings and, where available, our cookie banner. Disabling some cookies may affect functionality.
6. How We Share Information
We do not sell your personal data, and we do not share it for cross-context behavioral advertising.
- Service providers and processors: hosting, storage, CDN, payment processing, AI providers, analytics, email and customer-support tools, all bound by confidentiality and data-protection terms;
- Domain and integration partners you choose to connect (for example, a custom-domain registrar or a marketing tool);
- Legal and safety: when required by law, subpoena, or to protect the rights, property, or safety of Scalvigo, our users, or the public;
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this Policy;
- With your consent, or at your direction.
7. Data Retention
We retain personal data for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we delete or de-identify it. If you delete your account, we remove or anonymize your personal data within a reasonable period, except where retention is required by law.
8. Data Security
We use technical and organizational measures designed to protect personal data, including encryption in transit, access controls, and regular security reviews. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password and enable available security features.
9. International Data Transfers
Scalvigo operates globally and may process and store data in countries other than your own, including the United States. Where we transfer personal data from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses.
10. Your Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal data; to restrict or object to certain processing; to withdraw consent; and to not receive discriminatory treatment for exercising your rights (including under the EU/UK GDPR and the California Consumer Privacy Act as amended).
- To exercise these rights, email privacy@scalvigo.com or use the tools in your account settings;
- We will verify your identity and respond within the timeframe required by applicable law;
- If you are in the EEA/UK, you also have the right to lodge a complaint with your local supervisory authority.
11. Children’s Privacy
The Service is not directed to children under 16, and we do not knowingly collect personal data from them. If you believe a child has provided us personal data, contact privacy@scalvigo.com and we will delete it.
12. Third-Party Links and Sites
Our Service and the sites you build may link to third-party websites and services that we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a new “Last updated” date and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
